By using the Platform, you enter into a contract with Budjetshopping.com Internet Private Limited, and these terms and conditions, along with the policies, become your binding obligations with Budjetshopping.com.

In these Terms of Use, "You" or "User" refers to any natural or legal person who becomes a buyer on the Platform by providing Registration Data during the registration process as a Registered User. However, you can also browse the Platform and make purchases without registering. "We," "Us," or "Our" refers to Budjetshopping.com Internet Private Limited.

Membership Eligibility To use the Platform, you must be capable of forming legally binding contracts under the Indian Contract Act, 1872. If you are a minor and wish to make a transaction on the Platform, it must be done by your legal guardian or parents. Budjetshopping.com reserves the right to terminate your membership and/or deny you access to the Platform if we become aware that you are under the age of 18 years and engaging in transactions on the Platform.

Your Account and Registration Obligations If you use the Platform, you are responsible for maintaining the confidentiality of your Display Name and Password, as well as all activities that occur under your account. You agree that if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect such information, we have the right to suspend or terminate your membership indefinitely, block access to your account, and refuse you access to the Platform.

Your mobile phone number and/or email address serve as your primary identifier on the Platform. It is your responsibility to ensure that your mobile phone number and email address are kept up to date on the Platform. If your mobile phone number or email address changes, you must promptly notify us by updating the information on the Platform through a one-time password verification.

You acknowledge that Budjetshopping.com is not liable or responsible for the activities or consequences of the use or misuse of any information that occurs under your Account, including cases where you have failed to update your revised mobile phone number and/or email address on the Platform.

If you share or grant others access to your Account by creating separate profiles or in any other way, they will be able to view and access your Account information. You are solely liable and responsible for all activities undertaken under your Account and any consequences that may arise.

You must maintain the confidentiality of your account information and all activities that occur under your account. You must not share your login details, including your username and password, with any other person, as doing so would be considered a breach of these Terms of Use.

You agree to: (a) ensure that you log out successfully from your account at the end of each session, and (b) immediately notify Budjetshopping.com of any unauthorized use of your account. If we have reason to believe that there is likely to be a breach of security or misuse of your account, we may request you to change your password, or we may suspend your account for an appropriate period of time as we deem necessary. We shall not be liable for any loss or damage arising from your failure to comply with this provision.

You will have access to other apps owned by Budjetshopping.com group companies using the same login username and password. You agree to have a single login access to all the apps owned by Budjetshopping.com group companies

Communications When you use the Platform or send emails or other data, information, or communication to us, you understand and agree that you are communicating with us through electronic records. By using the Platform, you consent to receive communications from us via electronic records periodically and as required. These communications may be sent to you by email or through other electronic means.

Platform for Transactions and Communication The Platform facilitates transactions between buyers and sellers. Budjetshopping.com is not a party to or in control of any transaction between users of the Platform.

Hereafter:

1. All commercial and contractual terms are agreed upon solely between buyers and sellers. These terms include price, shipping costs, payment methods, delivery dates, warranties, and after-sales services related to products and services. Budjetshopping.com does not have control over or involvement in the offering or acceptance of such commercial and contractual terms between buyers and sellers. Any discounts or offers are provided by the seller/brand and not by Budjetshopping.com.
2. When a buyer places an order with a seller on the Platform, it is considered an offer to buy the product(s). The seller retains the right to cancel any such order at its discretion, and the buyer will be notified of the cancellation via email/SMS. If the seller cancels an order, any transaction price paid by the buyer will be refunded. Additionally, the seller may cancel an order if the quantities ordered exceed typical individual consumption. The determination of typical individual consumption is at the seller's sole discretion and may vary.
3. Budjetshopping.com does not make any representation or warranty regarding the specifics (such as quality, value, or salability) of the products or services offered on the Platform. Budjetshopping.com does not endorse or support the sale or purchase of any products or services on the Platform, either implicitly or explicitly. Budjetshopping.com is not liable for any errors or omissions made by itself or third parties.
4. Budjetshopping.com is not responsible for non-performance or breach of any contracts between buyers and sellers. Budjetshopping.com does not guarantee that buyers and sellers will fulfill transactions conducted on the Platform. Budjetshopping.com is not obligated to mediate or resolve disputes between buyers and sellers.
5. Budjetshopping.com does not make any representation or warranty regarding the item-specifics (such as legal title, creditworthiness, or identity) of its users. It is advised to independently verify the credibility of any user you choose to transact with on the Platform and exercise your own judgment.
6. Budjetshopping.com does not take possession of any products or services offered by sellers, nor does it gain any rights or claims over them during transactions on the Platform.
7. Budjetshopping.com does not hold any right, title, or interest over the products, nor does it have any obligations or liabilities concerning contracts between buyers and sellers. Budjetshopping.com is not responsible for unsatisfactory or delayed performance of services, damages, or delays arising from products that are out of stock, unavailable, or back-ordered.
8. The Platform serves as a communication platform that allows users to buy and sell products or services. The contract for the sale of any products or services shall be strictly between the seller and the buyer, forming a bipartite contract. Budjetshopping.com does not hold any right, title, or interest over the products, nor does it have any obligations or liabilities regarding such contracts. Budjetshopping.com is not responsible for unsatisfactory or delayed performance of services or damages or delays resulting from products that are out of stock, unavailable, or back-ordered

Select products offered by sellers may be eligible for business purchases on the Platform.

1. When you purchase products eligible for business purchases, you may avail the benefits of GST input tax credit. Upon your request, the seller(s) selling such products will issue a Tax Invoice to you, which will include the GSTIN provided by you.

• The GST invoice will contain the following details: your registered business's GSTIN, your registered business's entity name (as provided by you).
• Not all products are eligible for business purchases, and eligibility is at the discretion of the sellers. You can check the eligibility of a Tax Invoice on the product page.
• Purchases on the Platform should only be for end consumption and not for commercial, promotional, resale, or distribution purposes.
• To ensure seamless availment of input tax credit, use the delivery address as the registered place of business according to GST authority records. Note that the input tax credit is subject to the provisions of the GST Act and rules.
• The delivery and billing addresses must be the same. If the delivery address and GSTIN in the GST invoice belong to different states, input tax credit will be denied by the GST authority.
• If you do not provide a GSTIN and/or business entity details, it will be assumed that the purchase is for personal use and not a business purchase.
• Budjetshopping.com is not responsible for verifying the correctness of the provided GSTIN and/or entity name. You are solely responsible for providing accurate details.
• Budjetshopping.com and the seller will not entertain any requests for revision of the GST Invoice. They are not liable for any defaults or issues arising from the details provided by you.
• Budjetshopping.com is not liable if you are unable to avail input tax credit or if it is denied to you for any reason.
• You are solely responsible for complying with applicable laws.
• You agree to indemnify and hold Budjetshopping.com and the seller harmless from any losses, claims, costs, expenses, suits, proceedings, or liabilities arising from the GSTIN and/or entity name provided by you, the claimed input tax credit, or your use/misuse of the GST Invoice or any third-party details, including GSTIN.
• Budjetshopping.com has the right to disallow business purchases on the Platform if fraudulent activity is identified.
• The seller reserves the right to not issue a Tax Invoice or issue a credit note to cancel a transaction in case of fraudulent activity.

1. You are responsible for agreeing independently with the sellers on delivery, payment, insurance, and other terms and conditions for your transactions.

Disclaimer: The pricing of products on the Platform may occasionally have technical issues, typographical errors, or incorrect information published by sellers. In such cases, the seller may cancel your order(s).

1. You release and indemnify Budjetshopping.com, its officers, and representatives from any costs, damages, liabilities, or consequences arising from the actions of other users on the Platform. You waive any claims you may have under applicable law. While Budjetshopping.com makes reasonable efforts, it cannot control or take responsibility for the information provided by other users on the Platform. Exercise caution and practice safe trading when using the Platform. Some user-provided information may be offensive, harmful, inconsistent, inaccurate, or deceptive. Dealing with underage persons or those acting under false pretenses carries inherent risks.

Charges Budjetshopping.com may charge a nominal fee for browsing and buying on the Platform. The Fee Policy may be changed from time to time at Budjetshopping.com's discretion. This includes introducing new services/fees or modifying existing ones. Any changes to the Fee Policy will be posted on the Platform and will become effective immediately upon posting. All fees will be quoted in Indian Rupees. You are solely responsible for complying with applicable laws, including making payments to Budjetshopping.com Internet Private Limited in India

Use of the Platform By using the Platform, you agree to adhere to the following binding principles:

1. You shall not engage in any of the following activities on the Platform: (a) Hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any information that belongs to another person without the right to do so. (b) Posting content that is harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of privacy, hateful, racially or ethnically objectionable, or encouraging money laundering, gambling, or any other unlawful activity. (c) Sharing misleading information. (d) Sharing content that is patently offensive, sexually explicit, or promotes obscenity, paedophilia, racism, bigotry, hatred, or physical harm towards any group or individual. (e) Harassing or advocating harassment of another person. (f) Engaging in "junk mail," "chain letters," unsolicited mass mailing, or spamming. (g) Promoting illegal activities or engaging in abusive, threatening, obscene, defamatory, or libellous conduct. (h) Infringing upon or violating any third party's rights, including intellectual property rights, privacy rights, or publicity rights. (i) Promoting illegal or unauthorized copies of copyrighted works, such as pirated computer programs or ways to circumvent copy-protection measures. (j) Creating restricted or password-protected access pages, hidden pages, or images. (k) Exploiting people in a sexual, violent, or inappropriate manner or soliciting personal information from anyone. (l) Providing instructions on illegal activities, such as creating or buying illegal weapons, violating someone's privacy, or creating computer viruses. (m) Sharing video, photographs, or images of another person without consent. (n) Attempting to gain unauthorized access or exceeding authorized access to the Platform or soliciting passwords or personal information from other users for commercial or unlawful purposes. (o) Engaging in commercial activities and sales without prior written consent from Budjetshopping.com. (p) Soliciting or engaging in gambling activities that are considered illegal. (q) Interfering with another user's use and enjoyment of the Platform or similar services. (r) Referring to any Platform or URL that contains inappropriate material or violates the terms of use. (s) Harming minors in any way. (t) Infringing upon patents, trademarks, copyrights, trade secrets, or any other proprietary rights or engaging in fraudulent activities or selling counterfeit or stolen products. (u) Violating any applicable laws. (v) Communicating offensive or menacing information or misleading addressees or users. (w) Impersonating another person. (x) Distributing software viruses or any computer code designed to interrupt, destroy, or limit the functionality of computer resources or engaging in any other malicious activities. (y) Threatening the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, public order, or inciting the commission of any offense or preventing the investigation of any offense or insulting any other nation. (z) Providing false, inaccurate, or misleading information. (aa) Offering, attempting to offer, trading, or attempting to trade any item that is prohibited or restricted under applicable laws. (ab) Creating liability for Budjetshopping.com or causing loss of services from internet service providers (ISPs) or other suppliers.
2. You shall not use any automated tools or processes, such as "deep-link," "page-scrape," "robot," "spider," or similar methods, to access, copy, or monitor the Platform or its content without prior authorization. You shall not bypass or manipulate the navigational structure or presentation of the Platform to obtain unauthorized materials, documents, or information. Any such activity is strictly prohibited, and we reserve the right to take appropriate action.
3. You shall not attempt to gain unauthorized access to the Platform, its systems, or networks, or any other connected server, computer, or network. This includes hacking, password "mining," or any other illegitimate means of accessing or interfering with the Platform's security measures. You shall not probe, scan, or test the vulnerability of the Platform or breach its security measures. Additionally, you shall not trace or seek to trace information about other users or exploit the Platform or its services to obtain information that is not authorized for your access.
4. You shall not make any negative, denigrating, or defamatory statements or comments about Budjetshopping.com, its brand name, domain name, or sellers on the Platform. You shall not engage in any action that tarnishes the image, reputation, trade or service marks, trade name, or goodwill associated with Budjetshopping.com. Moreover, you agree not to overload or disrupt the infrastructure of the Platform or Budjetshopping.com's systems or networks, or any connected systems or networks.
5. You shall not interfere with the proper functioning of the Platform or any transactions conducted on it. You shall not use any device, software, or routine to disrupt or attempt to disrupt the Platform's operation or the usage of other individuals.
6. You shall not forge headers or manipulate identifiers to conceal the origin of any message or transmission sent to us through the Platform. You shall not pretend to be someone else or impersonate any individual or entity.
7. You shall not use the Platform or its content for any unlawful purpose or to solicit or engage in illegal activities that infringe upon the rights of Budjetshopping.com or others.
8. You are responsible for complying with the provisions of the Information Technology Act, 2000, and other applicable laws, regulations, and international laws regarding your use of the Platform and any transactions conducted on it. You shall not engage in any prohibited transactions under the applicable laws.
9. By providing us with your information, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sub-licensable right to use your information, including copyright, publicity, and database rights, to the extent necessary for us to operate the Platform and provide our services.
10. You are responsible for providing accurate information about the products or services you propose to sell on the Platform. You shall not mislead or exaggerate the attributes of your products or services in a manner that could deceive other users.
11. You shall not engage in advertising or solicitation of other users to buy or sell products or services, including those displayed on the Platform, without our prior consent. Sending chain letters, unsolicited commercial emails, or junk emails to other users is prohibited. We reserve the right to limit the number of messages or emails you can send to other users in a 24-hour period. Furthermore, we may disclose information about you to law enforcement or government officials if necessary to comply with the law or investigate potential illegal activities.

Budjetshopping.com has the discretion to remove or edit any content that violates or is alleged to violate any applicable law or the Terms of Use. However, you are solely responsible for the content you post on the Platform and in your private messages. Budjetshopping.com shall not be held responsible or liable for any claims, damages, or losses arising from the use or appearance of content on the Platform.
• Any correspondence or business dealings you have with advertisers on the Platform, including payment and delivery of products or services, are solely between you and the advertiser. Budjetshopping.com is not responsible or liable for any loss or damage incurred as a result of such dealings or the presence of advertisers on the Platform.
• There is a possibility that other users, including unauthorized users or "hackers," may post offensive or obscene materials on the Platform, and you may inadvertently be exposed to such content. Additionally, others may obtain personal information about you through your use of the Platform, which they may use to harass or harm you. While we do not approve of such unauthorized uses, by using the Platform, you acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others. • Budjetshopping.com has the right to take necessary action and claim damages resulting from your involvement or participation, whether intentional or unintentional, in DoS/DDoS (Distributed Denial of Services) attacks.
• If you choose to use the voice command-based shopping feature on the Platform, you acknowledge that Budjetshopping.com and/or its affiliates will collect, store, and use your voice inputs to customize your experience, provide additional functionality, and improve their products and services. Your use of this feature is limited to the territory of the Republic of India. Budjetshopping.com reserves the right to change, enhance, suspend, or discontinue this feature at any time without notice, and your continued use constitutes acceptance of the related terms.
• The translation features for languages such as Hindi, Telugu, Tamil, Kannada, Marathi, Bengali, Gujarati, Odia, Malayalam, Punjabi, and Assamese provided on the Platform are offered on a best-effort basis for convenience only. Budjetshopping.com does not provide any warranty or guarantee regarding the accuracy, completeness, or reliability of the translations. Some features and sections on the Platform may not be translated, and in case of any conflict or inconsistency between the translated terms and the English version, the English version shall prevail. Budjetshopping.com reserves the right to change, enhance, suspend, or discontinue this feature without notice.
• Please review the following Terms & Conditions related to donations to AKS CHARITABLE Foundation, a Section 8 company registered under the Companies Act 2013. The amount donated will be used to support NGOs and charitable organizations working in specific thematic areas. The donation is non-refundable, and no certificate under section 80G of the Income Tax Act, 1961 will be issued. By proceeding with the donation, you confirm that it is not from any foreign source as defined under the Foreign Contribution (Regulation) Act, 2010. Budjetshopping.com Foundation disclaims liability for the actions or inactions of the NGOs or charitable organizations. By donating, you waive any claims or remedies against Budjetshopping.com Group entities. Personal identifiable information may be shared with Budjetshopping.com Foundation.

The content posted on the Platform, including text, graphics, photographs, trademarks, logos, and artwork (collectively referred to as "Content"), is generated by third-party users, and Budjetshopping.com does not have control over it. As an intermediary, Budjetshopping.com is not responsible for the third-party user-generated content.

Unless expressly stated in these Terms of Use, you are not allowed to copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, or distribute any part of the Platform or the Content without the prior written consent of Budjetshopping.com.

You may download information about the products and services provided on the Platform for personal, non-commercial use, provided that you do not remove any proprietary notice, use it only for personal informational purposes, refrain from copying or posting it on any networked computer or broadcasting it in any media, make no modifications to the information, and do not make additional representations or warranties regarding the documents.
